DPI to hold public hearings

MADISON-On Friday, Jan. 8 beginning at 10 a.m., the Wisconsin Department of Public Instruction will hold a preliminary public hearing and comment period to consider promulgation of administrative rules under a statement of scope on a proposed permanent rule relating to biennial cleanup of department administrative rules.
The proposed administrative rule promulgated under scope statement SS 153-20 seeks to amend Wis. Admin. Code sec Ch. PI 19, PI 34, and PI 40 to make technical changes to existing DPI rules, which include correcting unnecessary rules and rules superseded by and in conflict with state statutes, resulting from the department’s biennial review of administrative rules, as required under Wis. Stat. 227.29. Other technical changes identified to clarify existing rules, but not necessarily meeting the criteria required under the statute, will also be included in the proposed rule.
Pursuant to Wis. Stat. 227.135(1), a statement of scope is prepared in advance of any rule that an agency plans to promulgate. It includes a description of the objective of the rule, a description of existing policies relevant to the rule, an analysis of policy alternatives, the statutory authority for the rule, estimates of the amount of time expected to develop the rule, a description of entities affected by the rule, and a summary of any federal regulation that is intended to address the activities to be regulated by the rule. As the rule is promulgated, the department will conduct an additional public hearing for the proposed rule.
The DPI will hold the public hearing via teleconference only. Additional information on attending the hearing is available at the end of this release. Written comments received no later than the date of the hearing will be given the same consideration as testimony presented at the hearing.

Public hearing on proposed changes to rules related to pupil services professionals licensing-
On Thursday, Jan.7 DPI will hold an administrative rules hearing from 2:30-4 p.m. to accept public testimony on proposed changes to permanent rules related to licensing of pupil services professionals.
The proposed rules seek to amend Wis. Admin. Code sec. PI 34, related to the following:
Clearinghouse Rule 20-082, amending PI 34 to clarify and create flexibility around licensing rules for pupil services professionals, which include school nurses, school psychologists, and school social workers.
The DPI will hold the public hearing by teleconference only. Additional information on attending is provided below. Written comments received no later than the date of the hearing will be given the same consideration as testimony presented at the hearing.
